Rochester, MN (KROC AM News) – A group of Rochester neighbors are suing the city to prevent a proposed housing project from moving forward.
The city council recently approved a zoning change for the project known as Legacy on Fourteenth. It consists of two lots on the north side of 6th Street and the west side of 14th Avenue SW.
The council’s vote came after hearing from several neighbors who opposed the proposal, which was rejected by the Town Planning and Zoning Commission. Six of the neighbors who opposed it have filed the lawsuit.
Among the allegations in the filing, they claim that the zoning change required for the project amounted to “illegal zoning”. ”They also claim that the council’s action is in violation of the city’s zoning regulations.
The lawsuit stated that the project would “cause great and irreparable harm to plaintiffs, including the deterioration of a traditional, established single-family neighborhood, increased density, parking lots, traffic, crowds, congestion and the resulting damaging effects on their own property values. ”
A court hearing on the lawsuit is due to take place in October.
